The role of the Data Protection Officer is to oversee the Group’s compliance with data protection legislation, including supporting the Board in the development and control of policies relating to the protection and privacy of personal data held by all data subjects.



KEY ACTIVITIES/ACCOUNTABILITIES


Relationship Management with Information Commissioner’s Office


To serve as the main contact point for with the Information Commissioner’s Office (ICO) on complaints, queries referred by data subjects, reporting on incidents notified to data subjects and audits by the ICO.


Relationship Management with Data Subjects and Others


To manage and ensure all data subjects’ information rights including complaints are processed in accordance with the required timescales and legislative obligations with oversight of the data subject rights, record management team.


To inform data subjects about how their data is used, their rights including the development and upkeep of the organisations privacy policies.


To handle other disclosure requests by third parties under the legislation.


External and Internal Changes


To monitor developments with the Data Protection legislation including PECR compliance including emerging guidance from the ICO, and case law developments.


To keep up to date and proactively monitor and report on external developments including changes in legislation, case law, ICO decisions through attendance at seminars and events and other information sources.


Working with compliance, to provide regular reports to Board/ Executive/ Heads of Department on these changes; prioritising and publishing relevant information to business owners and implementing new controls if required.


To provide summary reports on updates to business areas and provide advice on implementing changes within their business areas.




Data Protection Impact Assessments and Risk Assessments


To ensure data protection impact assessments (DPIA) are undertaken and support departments undertaken their own DPIAs on projects and ensure all risks are assessed and controls implemented.


Working with the cyber team and project managers, to ensure that DPIAs are integrated as part of the Change Methodology and procurement process.


To provide an additional source of advice to new projects to ensure privacy e.g. new uses of data and security considerations are considered as part of the design and implementation of the project and development of new policies/uses of personal data.


Data Sharing and Third Parties


To ensure data sharing assessment are completed working with the Procurement, and General Counsel to assess risks in data sharing and ensure compliance with transfers of data outside of the UK in line with EU and UK GDPR requirements.


Incident Reporting


To work with the Cyber, IT department to ensure there are clear policies and procedures to report and assess data breaches and incidents.


To make the decisions on which information incidents require reporting to the ICO within 72- hour period in line with the ICO’s Guidance based on incident reports provided by teams.


To ensure where appropriate that data subjects are informed of the data incidents including any potential risks to them and actions they may need to take.


Records of Processing Activities

To ensure comprehensive records are maintained of all data processing activities conducted by the organisation in line with the ICO’s best practice.


To ensure all inventories of relevant information are coordinated across the group organisation such as the information asset register and the supplier register to reduce duplication.


Auditing and Monitoring

To report quarterly to the Information Risk Committee on compliance with the Data Protection legislation, establishing a series of measures across departments and development of a dashboard.


To report at least annually to the Board on data protection matters or risks and provide additional information on request.


To manage an assurance programme working with other policy owners / teams including the IT Governance, Marketing, Cyber Security team to conduct audits of risks areas and make recommendations for improvement.


To ensure issues are proactively addressed by departments and escalated to the Executive as appropriate.



Liaison with External Lawyers


Working with the General Legal Counsel to escalate significant issues outside of the organisations expertise to external legal advisors, maintaining a record of advice to ensure actions are implemented and knowledge is retained.


Coordination of Activities/ Advice


To provide subject matter expertise and advice on data protection matters to Board, Executive and Heads of Department.


To ensure all data protection policies and procedures across the business are effectively coordinated, agreed, adopted and regularly reviewed to ensure there is pragmatic and consistent data protection framework established that achieves compliance.


Education and Training/ Expertise


Coordinate and contribute to a programme of awareness–raising, training and education to deliver compliance which supports the organisation in fostering a data privacy culture.



QUALIFICATIONS & EXPERIENCE


  • The Data Protection Officer should be a graduate, ideally with a post graduate qualification in data protection. Preferably from a legal, compliance, IT security or audit background


  • Technical skills & Knowledge


  • Up-to-date knowledge of IT technologies of relevance to Data Protection (e.g. Cloud/ Cyber security controls, encryption.)


  • Expert knowledge of data privacy legislation and an understanding of all the GDPR principles


  • Proven experience of data repositories and records of processing activities.


  • Experience of responding to data subject rights including subject access requests.


  • Understanding of risks and measures associated with handling medical and litigation records.


  • Proven ability to establish and maintain a high degree of credibility, respect and trust at all levels of the organisation


  • Able to conduct the role independently and with integrity.


  • Ability to make sound judgements and to prioritise resources and activities across a matrix organisational structure in order to manage and control data risks.


  • Experience of embedding data protection in an organisation and reporting on compliance at senior internal level.
