The CMC Legal Division operates on a global scale, comprising regional Legal Heads across the UK, Europe, and Asia-Pacific, supported by teams of senior legal advisors, legal professionals, paralegals, and administrative staff.

ROLE AND RESPONSIBILITIES

General Duties

  • Supporting the Head of Legal, Senior Legal Advisors, and the broader Senior Management Team in achieving CMC Markets' strategic goals.
  • Providing specialized advice on litigation, dispute resolution, and data privacy to relevant internal stakeholders.
  • Drafting and negotiating a diverse range of commercial agreements, including: client-facing terms of service; IT contracts (covering software licenses, cloud services, and SaaS agreements); marketing agreements (including sponsorship and event contracts); outsourcing contracts; market data agreements; various institutional and partner agreements; prime brokerage documentation (such as ISDAs); property agreements (leases and licenses); engagement letters for external consultants (related to finance/tax); and financing agreements (like facility agreements).

Supporting the Legal Team

  • Contributing significantly to the delivery of high-quality legal services to the CMC organization.
  • Exhibiting strong collaborative skills and coordinating with global legal colleagues in Europe and Australia to ensure the effective sharing of critical information.
  • Proficiently monitoring, tracking, and highlighting key legal and commercial risks as they emerge across various matters.
  • Keeping abreast of legal updates and disseminating pertinent information to other members of the Legal Team.
  • Identifying and implementing essential improvements in processes, procedures, and systems within the Legal Team.
  • Embracing new challenges and fostering a growth mindset for continuous professional development.
  • Performing additional duties as reasonably required, consistent with the overall responsibilities of this role.

Collaboration with Other Departments

  • Assisting the Compliance Team in addressing complaints, financial promotions, regulatory matters, and rule changes impacting CMC's operations.
  • Reviewing marketing materials in collaboration with the Compliance Team.
  • Supporting the Operations Team with project work related to the CMC trading platform.
  • Assisting the Institutional Team by preparing agreements and updating global legal advice and due diligence.

International Perspective

  • Providing legal support and guidance to CMC's international branches and offices.
  • Ensuring that modifications to CMC's terms of service globally comply with local regulations and laws.
  • Facilitating the expansion of CMC's global operations and addressing cross-border considerations, such as new office openings.
  • Safeguarding CMC's intellectual property rights worldwide and taking necessary actions to prevent infringements.

Key Responsibilities

  • Ensuring comprehensive mitigation of legal risks and addressing legal issues in line with best practices.
  • Effectively managing external advisors to optimize costs while maintaining high-quality legal counsel.
  • Possessing a thorough understanding of the financial services sector and its challenges, including legal developments relevant to CMC's business.
  • Continuing personal and professional development to adapt to the evolving demands of the role, including all necessary regulatory and legislative training.
  • Providing a clear, fair, and consistent high-quality service to customers, clients, and colleagues, thereby presenting a professional image of CMC Markets.
  • Taking all reasonable measures to ensure confidentiality.
  • Carrying out additional duties, training, and/or hours of work as may be reasonably required, consistent with the general level of responsibility for this role.

KEY SKILLS AND EXPERIENCE

  • Qualified solicitor with a minimum of 3 years post-qualification experience in England and Wales. Solicitors qualified in other jurisdictions may be considered if they demonstrate a commitment to qualifying as a solicitor in England and Wales and possess the requisite experience.
  • Experience in litigation, dispute resolution, or data privacy.
  • Exceptional written and verbal communication skills, with the ability to convey complex legal concepts succinctly.
  • Strong organizational, analytical, and negotiation abilities.
  • Capability to work independently and collaboratively as part of a team, taking on managerial responsibilities when appropriate.
