Overview:
The Chairperson of the National Appeal Panel for Entry to Pharmaceutical Lists is appointed by Scottish Ministers following consultation with all Health Boards, the Scottish Department of the Royal Pharmaceutical Society of Great Britain and Community Pharmacy Scotland.

To Chair the National Appeal Panel for Entry to Pharmaceutical Lists (NAP). To evaluate appeals received from Health Boards via the Secretariat and determine whether there are grounds for appeal. To Chair the panel hearing appeals to ensure a full and fair hearing for all parties concerned. To provide a written decision of the Panel findings within 5 working days of the Hearing.

**Day Rate of Pay**

The day rate of pay is £554.92

**Time Commitment**

Based on the current (2001) caseload, it is expected that the Chair will be involved in hearings for approximately 1 ½ days per month.

**Responsibilities**:

- To consider appeals and determine whether to hear or dismiss an appeal, taking into account advice from the Scottish Government Legal Advisors and discussions with the Vice Chair.
- To instruct the Secretariat to make all administrative arrangements for those appeals going to a hearing
- To Chair the Appeal Hearing and ensure that procedures as detailed in the Regulations are followed.
- To lead the Site Visit immediately prior to the hearing to ensure the panel is adequately informed of the topographical and social issues of the neighbourhood under consideration.
- To ensure that the Panel applies the legal test in reaching its decision.
- To conduct the hearing in a manner conducive to the equal and fair treatment of all the participating parties, and their understanding of the proceedings.
- To ensure that all panellists are given the opportunity to participate in the deliberation of issues and, as appropriate, contribute to the final decision.
- To give the casting vote in the event of a tied vote to ensure a decision is reached.
- To agree and sign the Decision letter drafted on her/his behalf and send to the Pharmacy Practice Committee involved to ensure the timeous dissemination of decisions to the parties.
- Encourage and participate in training for NAP members and administrators
- Respond to issues and queries raised
- Liaise with Secretariat to maintain overview of NAP status and case load.
- Keep up to date with wider policy issues regarding pharmaceutical practice and the NHS in Scotland.

**Essential Criteria**
1. Decision making skills based on the evaluation of written and oral evidence

2. Ability to understand complex issues.

3. Ability to direct panel members to focus on key issues.

4. Highly developed interpersonal skills needed to pull together panellists selected on an ad hoc basis from a large pool.

You will be expected to remain in post for a minimum of three years unless successful at gaining promotion to a higher Band or Grade.
