Commercial Director
Reporting into an Executive Director you will work proactively and collaboratively, with other Executive Committee members and senior leaders, to create a commercial vision, drive commercial activities and ensure that we obtain relevant and value for money services from third parties to deliver on our overall organisation strategy.
Contract: Permanent
Working hours: 35 hours per week is full time. Where possible, we are open to considering part time/flexible working patterns. Please let us know in your application your desired working pattern.
Salary: From £124,000
Reporting to: Chief Finance and Risk Officer
Our permanent hybrid policy sees us all working at least four days across a fortnight in the office.
With a hands-on approach, you will bring the commercial rationale to the debate, tirelessly making the case for commercial efficiency and creating the tension necessary to drive value for money. Working with our transformation and continuous improvement teams you will be scanning the horizon for new technologies and ways of working that can deliver improved value.
This includes providing commercial leadership during all phases of the life cycle, from initial understanding of a business objective, through the procurement of any third-party services to support achieving this, the in-life management of third-party contracts and having clear exit strategies.
Key responsibilities
- Bringing commercial leadership and influencing senior stakeholders to make sound commercial decisions, sponsoring commercial initiatives
- Paying the “right price” for the “right service”, ensuring the right service aligns to our strategy and delivers value for money
- Developing a clear commercial strategy, approved by the Executive and the Board, that balances near-, mid- and longer-term time horizons and underpins the organisational strategy either committed to or anticipated
- Supporting the Executive Committee, the Board, and the organisation, in making sound commercial decisions and managing commercial, operational and legal risk
- Thought leadership, developing a strategy and execution plan, on the impact of external legislation or guidance, e.g., Environmental Social Governance (“ESG strategy”), scope 3 greenhouse gas emissions, Procurement Act.
- Representing the Financial Ombudsman Service on commercial matters externally, including with the Crown Commercial Service, with other members of the financial regulatory family and at industry events.
- Working collaboratively with Executive members (and other senior leaders) to shape demand for commercial success.
- Ensuring compliance with current public sector procurement regulations and ensuring any future changes (e.g., from the upcoming Procurement Act) are incorporated
- Achieving value for money, being clear on volume commitments, unit rates, term, inflation management, benchmarking, achievement of specified outcomes
- Managing contract risk, to include liability coverage, termination rights, service levels and credits, intellectual property rights, contractual triggers, and remedies
- Overseeing appropriate vendor and contract governance across the organisation, including governance meetings, reporting and scorecards.
- With the appropriate Executive Committee member, forming half of the senior governance team that faces off to key suppliers.
- Representing the public face of the Financial Ombudsman Service with existing and potential suppliers, ensuring that we are a customer that suppliers want to work with.
- Reporting key supplier performance to the Executive Committee.
- Ensuring we have contract compliance across the organisation, providing guidance on how to leverage Terms & Conditions, identifying and negotiating service credits
- Ensuring we have in place a clear and followed a compliant contract change control process for any contract amendments
- Leading an effective and efficient commercial function, ensuring it is appropriately sized, skilled and experienced to deal with the evolving demands of our organisation
- Owning the overall supplier stakeholder map, so we have a joined up and appropriately managed landscape, supporting Executive members (and other senior leaders) directly with the larger supplier relationships and leading on contract negotiations, delivery and disputes
To be considered for this role, you’ll need to show us that you’ve got the skills and capabilities. You’ll have to meet the following minimum criteria:
- Substantial experience of translating organisation strategy into a commercial strategy and execution plan
- Demonstrable experience working with Board and Executive level stakeholders, influencing discussion and decisions, cutting through to the points that matter the most
- Demonstrated experience of leading on large value commercial negotiations and contractual commitments, including being compliant with public sector rules
- Significant experience of providing the commercial counterweight in strategic planning initiatives and in creating the commercial tension necessary to drive efficiencies.
- A strong track record of operating as part of a senior leadership team, ideally in a large organisation which prides itself on customer service excellence
- Effective line management of the core commercial teams
We would also like you to have the following skills:
- Strong commercial aptitude, creative thinking, and a strategic approach
- You will be comfortable dealing with the ambiguity that is an inevitable consequence of major change and transformation initiatives
- Being a confident, inspiring, and credible communicator able to clearly articulate the steps
- Superb analytical and problem-solving skills, using data and insight to create recommendations and drive improvements
