JobSummary:

We are lookingfor an experienced Review Officer with extensive housing knowledgeand the ability to complete both Part 6 & 7 Housing Act1996 reviews.

To ensure thatstatutory reviews are carried out within the statutory timelimits.

To liaise withthe Legal Department and Head of Service to defend legal challengeswhether that is from judicial review proceedings or County Courtappeals under section 204 of the Housing Act1996.

To ensure thatcomplaints MP Member & solicitor enquiries are logged andresponded to within targettimeframes.

KeyDuties/Accountabilities:

To ensure thatall housing reviews and appeals (housing register homelessnessdecisions offers of social and temporary accommodation) are loggedmonitored and carried out efficiently and within prescribed timelimits.

To liaise withthe Allocations Team Accommodation Services and the Case work Teamto ensure that all relevant information has been gathered toaddress the requests for reviews of homeless & housingregister assessments and social & temporary accommodationoffers.

To have regularmeetings with the council s Legal Department in order to ensurethat Section 204 appeals and judicial review proceedings aredefended and to ensure that deadlines are met for witnessstatements and skeleton arguments in defence of County Court orHigh Courtappeals.

To ensure thatlegal costs are minimised in relation to threatened/actual courtaction.

To monitor andprepare reports for the Head of Service and Members on performancein respect of decision reviews and courtcases.

To beresponsible for developing procedures guidelines and model lettertemplates in relation to taking and processingapplications.

To take accountof good practice initiatives developed by other local authoritiesand government(DLUC).

Whenappropriate arrange oral hearings for clients in line withregulation 7 of the Homelessness (Review Procedure etc.)Regulations2018.

To examinereports and case notes prepared by the Case Work Officers onapplications prepared forreview.

To identifyshortcomings or trends where remedial action isrequired.

To ensure thatthe Case work Team is fully aware of current caselaw and of anyrelated legislation/regulations in order that casework is of highquality and that fully informed decisions are reached byofficers.

To highlightanomalies/irregularities in the Allocations Scheme (as part of theannual review) and homelessness and accommodation procedures thatarise from appeals in order to minimise the risk of courtaction.

To obtainmedical reports from GPs/ Consultants and to seek recommendationsfrom the inhouse medical adviser the Mental Health ProfessionalsMeeting or an independent consultant for the purpose ofinvestigating areview.

Authorise andwhere appropriate make recommendations on the placement intotemporary accommodation of persons to whom the Council owes aduty.

To exercisediscretion in deciding whether to continue providing accommodationpending a review or county courtappeal.

To take a leadon briefing the Council s solicitors andcounsel.

To attend courtwhere appropriate and in particular in relation to section 204appeals and judicialreviews.

EssentialExperienceRequired:

The successfulcandidate will be able to work independently using their owninitiative.

Experience ofcarrying out complex housing enquiries and producing well writtenlegally sound decisions is essential as is the ability to liaisewith solicitors and other representatives on a regularbasis.

Highly detailedknowledge of current and emerging housing legislation and case lawrelated to housing advice issues including private sector landlordand tenant law security of tenure homelessness law housing benefitand other welfare benefit regulations possession proceedings in thecounty court including court procedure rules Community legalServices funding rulesetc.

Additionalinformation tonote:

The role isremote however there may be occasions when youare required to attend ouroffices.

The role is foran initial period of 3months.
