Role Summary:
As an Assurance and Compliance manager, the post holder will be a member of a dynamic Commercial Function delivering an effective service supporting managers and staff across the East West Rail Company (EWR Co).  The role is critical in ensuring that we remain compliant with the requirements of the Procurement Act and other regulatory requirements such as Government spend controls and EWR Co governance.

The post holder will be responsible for making sure that the EWR Co has the mechanisms in place to demonstrate compliance with all relevant procurement regulations and will be versed in probity, legal and regulatory matters, GDPR, government and corporate governance best practice. The post holder will be comfortable with strategic, conceptual thinking and producing high quality deliverables.

The role will require collaboration with a wide range of different stakeholders across EWR Co.

Team dimensions:
East West Rail operates a matrix structure. This role sits within the Commercial Community. The post holder will report directly to the EWR Co Commercial Head of Procurement Assurance. Collaborating closely with the other teams in the Commercial Function to drive towards achievement of both EWR Co goals and the programme’s commercial objectives.

Key ResponsibilitiesIt is envisaged that the post holder will lead and work with members of the Commercial team and other stakeholders in setting, documenting, and implementing strategy in the key areas of:

Assurance, Compliance:
  • Develop a detailed compliance framework to demonstrate regulatory compliance across the commercial lifecycle, embedding compliance requirements processes and governance controls.
  • Provide expertise of best practice methodologies regulatory requirements, policy imperatives, innovation, and technological developments in relation to procurement compliance for EWR Co commercial activity.
  • Identify, manage and report instances of regulatory non-compliance across the commercial lifecycle and identify process improvements to reduce or mitigate the risk of regulatory non-compliance.
  • Liaise with the Head of Commercial Assurance and Compliance to map out and maintain a comprehensive assurance map that will work in practise and facilitate a high level of confidence in EWR Cos commercial performance.
  • Able to confidently perform compliance and progressive assurance reviews across any aspect of the Commercial Lifecycle from start to finish, producing exemplary reports and issue trackers that provide confidence to commercial lifecycle stakeholder either individually or as part of a small team (including external providers)
  • Identify lessons learned across the commercial lifecycle from themed assurance and compliance reviews and analysis.
  • Provide compliance and risk advice and expertise within the Commercial directorate. 
  • Report directly to the Commercial Leadership team on issues of non-compliance and continually create appropriate ways to log risks and issues.
 Probity (Including Conflicts of Interest)
  • Leading on management of conflict of interest and probity related enquiries 
  • Develop and Ensure EWR Co conflict of interest policies and practice maintain alignment with best practice in the sector and beyond and can be evidenced to meet the requirements of Part 5 of the Procurement Act 2023 for all procurements.
  • Act as primary point of contact for the declaration of interests, maintaining a database of all interests (including public registers where appropriate) cross referenced against ongoing workstreams and formal logging of appropriate protections and safeguards in response to conflicts. 
  • Proactively engages with colleagues across the Project to raise awareness of the importance of conflict-of-interest matters.
  • Lead in sharing good practice with other teams both internal and external to EWR Co Commercial directorate teams on probity matters. 
  • Maintain accurate records and documentation related to Conflict of Interest and compliance matters to allow for internal and external audits.  Undertake accurate record reviews across procurements to ensure there are accurate records kept for all stages of the procurement process including planning, sourcing, and contract management, including supporting how decisions are arrived at.
  • Responsible for regular engagement sessions, presentations, ‘lunch and learn’ sessions, etc with EWR Commercial and other staff to facilitate the highest standards in commercial compliance across the Programme.
General:
  • Understand the requirements of the Procurement Act and other regulatory matters in relation to commercial lifecycle activity to ensure that all work undertaken underpins being able to demonstrate compliance.
  • To support the Category and Contract Managers in respect of live tenders and contracts to ensure the highest standards of governance and compliance and to build strong and critical relationships across the commercial team and other stakeholders.
  • Acting as a role model for EWR Co’s vision and values, by supporting the EWR Co commitment to customer service, promoting diversity in the workplace, adopting appropriate behaviour when interacting with colleagues, and encouraging and supporting others to do the same.

Skills, Knowledge and Expertise
  • Highly experienced in assurance, compliance, probity matters, specifically having worked within regulated environment.
  • Attentive to detail, analytical with strong ability to examine external and internal submissions and enquiries.
  • Experience in major procurement.
  • Practical knowledge of public sector procurement legislation and knowledge of government commercial policies and objectives.
  • Versatile in your approach to adapt to evolving situations.
  • Excellent communication and people skills.
  • Adaptable to changing circumstances and environments - adjusting priorities, strategies, and approaches in response to evolving needs and challenges.
  • Resilient with the ability to bounce back from setbacks and obstacles while remaining focussed on goals.
  • Proficient in navigating change and periods of transformation while maintaining effectiveness.
 Education and qualifications:
Degree in a related field such as Law would be advantageous, but not essential or have full membership of a relevant professional body such as CIPS but this is not a requirement for the role. You can demonstrate your skills and knowledge through a proven record of delivering procurement and contract-based projects.

Demonstrate an assurance, compliance and risk skillset through a relevant professional qualification or demonstrated through your skills and experience.
