Position Responsibilities

The Lead Cybersecurity Counsel will operate under the directives of the Commissioner and Executive Team. Responsibilities include advising on appropriate legal strategies, including guidance on ICO cybersecurity policies during specific regulatory actions, which may encompass enforcement, prosecution, or appeals based on case specifics.

As a recognized legal authority in cybersecurity, the Lead Counsel will extend technical support regarding cybersecurity and related data protection laws to investigators, subject matter experts, legal professionals, and other stakeholders within the organization.

The incumbent will primarily oversee and manage legal operations related to cybersecurity, particularly concerning intricate and high-profile cases. Close collaboration with technical experts in the ICO's Regulatory Cyber division, as well as with legal peers, will be essential. Additionally, the role involves ensuring that knowledge and development in this intricate field are shared and cultivated across relevant teams within the ICO.

Key Responsibilities

  • Deliver strategic, high-quality, timely, and risk-based legal advice on inquiries from across the ICO, with a focus on managing and supervising legal counsel on complex and high-profile cybersecurity matters.
  • Provide expert legal insights within designated areas of responsibility, staying well-informed about relevant legislation and procedural guidelines, while leading the development of strategies for novel and complex legal challenges.
  • Supervise and guide in-house legal professionals and direct external legal counsel on significant legal cases and legislative issues.
  • Drive continuous improvement across all areas of responsibility, recommending changes and leading initiatives to ensure successful implementation.
  • Represent the Commissioner/ICO at national and international meetings and events where senior representation is necessary, which may involve travel.
  • Identify potential opportunities and risks to the ICO's reputation, recommending enhancements to information rights and cybersecurity practices in targeted sectors.
  • Engage with media and external stakeholders on critical legal matters pertinent to the ICO's operations.
  • Advise on guidance materials published by the ICO to ensure legal accuracy and compliance with current legislation, while leading strategic legal input in specialized areas.
  • Independently manage a caseload of ongoing cybersecurity legal issues, ensuring alignment with ICO standards, policies, and regulatory priorities.
  • Contribute to the broader operations and influence of the ICO by participating in projects and advising on policy and procedural development.

Candidate Profile

Essential Qualifications:

  • Qualified to practice as a Solicitor, Barrister, or Chartered Legal Executive in England and Wales, or possess an equivalent professional qualification from another jurisdiction, with potential requirements to undertake qualifying examinations.
  • Extensive experience providing complex legal advice in high-pressure environments, either in advisory roles or managing significant enforcement cases.
  • Proven experience in advising on cybersecurity and data protection law, ideally within an information technology context.
  • Experience supervising other legal professionals, with a capacity to develop management skills.
  • Ability to identify, manage, and influence opportunities for ongoing improvement and change.
