Job summary

This is an exciting opportunity for a highly motivated individual to join the mental health legislation team as the trust lead for the Mental Capacity Act/ Mental Health Act.

The successful applicant will have an in-depth knowledge and understanding of the Mental Capacity Act (MCA) and Mental Health Act (MHA) with experience of working within a complex health or social care organisation.

Using your knowledge of the Mental Health Act and Mental Capacity Act, you will work closely with the Head of Mental Health Legislation to provide trust staff with expert support, information, training and guidance on issues relating to the MCA and DOL/ Liberty Protection Safeguards. The role also requires collaborative working and the development of effective multi-disciplinary and multi-agency relationships with all partner agencies, providing leadership and management of Deprivation of Liberty through provision of policy, governance and service development.

Agile working is critical to this role as the successful candidate be required to support staff across the whole trust.

Main duties of the job

This role will support with the promotion and development of local provision to meet the legislative requirements of the Mental Health Act and particularly the Mental Capacity Act 2005 (MCA), including Deprivation of Liberty Safeguards (DoLS)/ Liberty Protection Safeguards (LPS) within the Trust.

To assist in ensuring effective policies, procedures and systems are in place for the MHA, MCA and DoLS in accordance with the Acts and Codes of practice. To assist with implementing, where possible, any improvements or changes in procedures as may be required from time to time by changes in working practice or play a key role in the operational implementation of both Acts throughout the organisation as Lead for Mental Health Act and Mental Capacity Act. To support the development, implementation and management of vigorous systems and procedures that administer the statutory regulations of the Acts are in accordance with recognised good practice, including the production of procedures and policies, staff training and audit.

Job responsibilities

Working with the Head of Mental Health Legislation, Ward & Community Team Managers (and their deputies) and Clinicians to ensure the effective delivery of the MHA, MCA & DoLS in practice, ensuring good governance and an effective committee & reporting infrastructure. To be responsible for ensuring that the MHA/ MCA systems and processes are developed and updated. The post holder will lead the implementation, integration and continued development of the MHA and MCA across the Trust. To develop effective working arrangements with staff at all levels and to work with Operational Managers and other agencies to ensure that DOLS is used effectively within services, ensuring that monitoring processes and reporting formats are in place. To manage the trust-wide Mental Health Legislation office/function Line-manage the day to day operations of the team, establish clear lines of accountability & responsibility & provide effective management supervision. Undertaking & completion of annual staff PDC / Appraisals Ensure the provision of an advisory service / expert resource to all clinical wards and teams on matters pertaining to the MCA, DoLS and MHA providing advice and guidance for all complex enquiries, complaints or allegations that may have legal, ethical and professional implications.

To work in close collaboration with designated safeguarding professionals for MCA/DoLS/LPS in order to share and implement good practice. To attend and contribute to relevant meetings within the Trust to ensure positive engagement of all members of staff with the problems associated with MCA/DOLS/LPS. To support with the delivery of appropriate training & uptake for Trust staff in the MHA, MCA, DoLS & the effect of orders from the Court of Protection. To utilise expertise and recognised best practice to provide advice on all aspects of MCA/DOLS including least restrictive routes. Consideration of budgetary constraints when planning service delivery and managing resources within realm of responsibility Responsible for authorising procurement of supplies for the department. To provide regular reports on the operation of the MCA within the Trust and to propose improvements to senior colleagues via the required groups to educate and inform including such information as numbers referred under the MCA, incidents, breaches, appeals and subsequent action taken. To facilitate and maintain effective communication and liaison systems, within and across Trusts and with other agencies, as local and out-of-area requirements. To maintain continuity and consistency of information-sharing active. To contribute periodically to complaints or investigations where investigation includes a focus on Mental Health Act, Liberty Protection Safeguards and Mental Capacity Act legal compliance Support staff in the preparation and submission of documents for court proceedings for the Court of Protection or Family court matters Maintain awareness of up to date case law and understand how this informs local practice To expand and maintain professional knowledge and skills in relation to MHA, LPS and MCA by keeping abreast of current trends/initiatives and related developments To undertake any other duties of a similar nature consistent with the responsibilities of this post in order to provide a quality service
