Reporting to the Head of Commercial, our client is looking for someone who provides effective commercial management and governance of contracts, projects, bids and all commercial offerings for the business.
You will also be expected to act as the primary point of contact with Customers and Subcontractors for all commercial matters relating to contracts and bids, provide an independent oversight to ensure that the business secures commercial agreements that minimiserisk, maximise financial outturn (profit and cashflow), optimise our wider commercial opportunities, and are compliant with relevant standards, internal processes and legislation as well as assuming line-management responsibilities with respect to commercialofficers.
**Responsibilities**:
Contract Management
Draft, negotiate and agree Customer Contracts and other relevant commercial documents as required.
Draft, negotiate and agree sub-contracts for major/complex procurement agreements, and undertake commercial management of sub-contractors.
Consult external advisory bodies on specific matters of commercial best practice.
Formally instruct and advise the business on its contractual agreements and obligations.
Work effectively with Project Managers to ensure Contract Change is managed with customers to ensure interests are protected.
Coordinate contract reviews for new projects, highlighting areas of Commercial risk.
Provide support to business reviews.
Build customer relationships to manage existing contracts and resolve commercial issues
Negotiate and agree Collaboration Agreements as required (Non-Disclosure Agreements, Teaming Agreements, Royalty/ IP Licence Agreements).
Commercial Proposals
Act as formal point of contact with the Customer for all communication following ITT publication and during the proposal-negotiation phase.
Prepare Commercial input to bids, including draft contract review and advice and budgetary estimates.
Provide commercial input to risk assessments and pricing strategy.
Prepare and issue ITT data packs to prospective sub-contractors.
Co-ordinate bid price approval and ensure sign-off is in line with policy.
Complete milestone/cash flow analysis and any foreign currency analysis for proposal, liaising with Finance to review business impact and risk mitigation.
Understand and implement the company environmental, health & safety policy by accepting individual responsibility and responsibility for those personnel under their authority, including others who may be affected by the company's activities.
Ensure personnel are aware of their responsibility towards H&S and are equipped accordingly.
Always set a strong personal example regarding all health and safety matters.
Divisional Management
Provide input into Divisional budget, order intake and forecast processes.
Participate in Divisional Management meetings as required.
Provide independent commercial advice to Divisional Management, project and bid managers.
Assess Divisional commercial risks and develop mitigation plans.
Contribute to the development and improvement of business processes.
Provide commercial induction and refresher training as required.
