Lead for Data Security and Protection (Information Governance)
The Lead for Data Security and Protection will offer strategic direction and expertise to ensure compliance with the standards set forth in the National Programme of Information Governance. This encompasses the General Data Protection Regulations (GDPR), Data Protection Act 2018, Freedom of Information Act 2000, Caldicott Guidelines, and Corporate Record Management.
This position serves as a primary resource for expert counsel and policy formulation regarding the General Data Protection Regulations. The role aims to foster a comprehensive understanding of the strategic and practical significance of Data Protection, assuring the Trust Board that all statutory and legal responsibilities are being met.
The Trust Board and senior management are dedicated to upholding high standards of Data Protection, which is essential for delivering exceptional patient care.
Key Responsibilities
- Provide expert advice, guidance, and reporting on Data Protection matters to the Trust Board and its Executive team.
- Offer support and direction to staff and patients concerning confidentiality and security concerns.
- Develop internal policies and protocols for sharing patient-identifiable information in accordance with the Data Protection Act 2018, while supporting the Caldicott Guardian in their role as Protector of Patient Information.
- Collaborate with the Caldicott Guardian to provide guidance to staff on obtaining consent from individuals when their personal information is utilized in ways that do not directly contribute to their care.
- Liaise with the Caldicott Guardian regarding information requests, data breaches, or access rights and sharing of information.
- Act as a deputy for the Caldicott Guardian in their absence and assist with Caldicott-specific reporting.
- Oversee the management of Data Protection Subject Access Requests by the Data Access & Disclosure team, ensuring compliance with established procedures.
- Review and update the Trust's registration with the Information Commissioner as mandated by the Data Protection Act 1998 and GDPR.

Job Requirements
Qualifications and Experience
Essential
- A degree or equivalent specialized experience in Data Protection, Freedom of Information, and General Data Protection Regulations.
- Proven experience in Information Governance.
- In-depth knowledge of the General Data Protection Regulations, Data Protection Act 1998, Freedom of Information Act 2000, EIR, Caldicott Reports, and corporate record management.
- Familiarity with the NHS Records Management Code of Practice and the DSP Toolkit.
- A minimum of 5 years' experience in Information Governance or a related field.
Desirable
- Practitioner Certificate in Data Protection.
- Practitioner Certificate in Freedom of Information.
- Understanding of the Human Rights Act 1998 and Crime & Disorder Act 1998.
- Knowledge of legal issues related to the Woolf Report (pre-action disclosure) for personal injury claims.
- Several years of experience in implementing or managing Data Protection, FOI, and Records Management within an organization.
