Position Overview

An exceptional opportunity has emerged within the Royal United Hospitals Bath NHS Foundation Trust for the role of Lead Practitioner for Mental Capacity Legislation (MCL) and Deprivation of Liberty Safeguards (DoLS).

This is a pivotal moment to become part of our evolving service dedicated to supporting vulnerable individuals. The successful applicant will integrate into a collaborative team of committed professionals focused on enhancing service delivery and health outcomes.

Key Responsibilities

The primary duty of this role is to oversee all aspects related to the Mental Capacity Act and Deprivation of Liberty Safeguards. The MCL/DoLS Lead will collaborate with Safeguarding Leads to ensure comprehensive understanding and adherence to the Mental Capacity Act and Deprivation of Liberty Safeguards across the Trust.

In the event that the Deprivation of Liberty Safeguards is superseded by a new legal framework (such as the Liberty Protection Safeguards - LPS), it is anticipated that the Lead Practitioner for MCL/DoLS will spearhead, develop, and facilitate the implementation of the LPS in conjunction with multi-agency partners.

This position is suitable for a Registered Nurse, Allied Health Professional, or Social Worker.

Main Duties

- Strategically guide the development and execution of the Trust's statutory obligations and requirements under the Mental Capacity Act and DoLS.

- Direct the strategic approach to practice concerning the Mental Capacity Act (MCA) and Deprivation of Liberty Safeguards (DoLS), collaborating with internal and external stakeholders to embed the principles of the Act.

- Work across the Trust and with partner organizations to ensure that the principles, functions, and applications of MCA/DoLS are integrated within all relevant policies and services in compliance with legislation.

- Provide clinical leadership and expert advice on all matters pertaining to MCA/DoLS.

- Serve as a subject matter expert regarding the relationship between the MCA and Mental Health Act in an acute hospital environment, assisting clinical staff in high-pressure situations to apply the most suitable legal framework to safeguard the rights of the Trust's most vulnerable patients.

- Offer expert MCA guidance to support clinical staff in conducting safeguarding investigations, serious incident inquiries, or complaints for patients who lack the capacity to make decisions regarding their care or treatment.

- Lead governance and assurance initiatives related to MCA and DoLS.

Qualifications and Training

Essential

  • Valid professional registration with a recognized professional body such as NMC, Health and Care Professions Council (HCPC), or Social Work England.
  • Degree-level education in a relevant field.

Desirable

  • Master's Degree (or in progress) in a relevant specialty.
  • Best Interest Assessor Qualification.

Knowledge and Experience

Essential

  • Comprehensive understanding of the interplay between the Mental Capacity Act and the Mental Health Act in a hospital context.
