Job summary
Applications are invited for the role of His Majesty�s Chief Inspector of Prisons for Scotland (HMCIPS) who is responsible for conducting inspections and preparing reports on Scotland�s prisons.
The appointment of HM Chief Inspector of Prisons for Scotland is made by Scottish Ministers although, once appointed, the role is independent of Scottish Minsters and the Scottish Prison Service. They are required to provide an Annual Report to Scottish Ministers and lay such reports before the Scottish Parliament.�
They report to Scottish Ministers on the treatment of prisoners and the conditions in prisons and the exercise of the functions of independent monitors. Within these requirements, HM Chief Inspector has the flexibility to decide how to carry out the duties of the post.
HM Chief Inspector of Prisons for Scotland is required to oversee the functions of circa 120 volunteer Independent Prison Monitors (IPMs) who ensure that every prison is visited every week to monitor the conditions and treatment of prisoners, and to work with the Prison Monitoring Advisory Group to keep the effectiveness of monitoring under review.
About Us
HM Inspectorate of Prisons for Scotland, (HMIPS) was established on 1 January 1981, following the publication of a report in 1979 by the Committee of Inquiry into the United Kingdom Prison Services (The May Committee).� This report recommended that there should be a system of inspection of the Prison Service distanced as far as may be practicable from the Prison Department. The role of HM Chief Inspector of Prisons for Scotland continues to be appointed under Royal Warrant.�
Based in Saughton House, Edinburgh, the Inspectorate comprises HM Chief Inspector, a Deputy Chief Inspector, an Inspector of Prisons, Thematic Lead Inspector, Head of Business Management/Inspector, Inspector of CCUs, Senior Researcher, four regional Prison Monitor Co-ordinators, and three Business Support Officers. In addition, a number of other specialist inspectors also contribute when relevant to the inspection process.
This post is based in Edinburgh and whilst Scottish Government operates a flexible, hybrid approach to working, the Executive Team expects agreements to be reached locally for roles suited to hybrid working. These agreements should ensure colleagues combine working from home with a presence in a workplace (and for some roles, with stakeholders and in communities) each week.
This may vary from week to week depending on business need and we recognise some roles will be more location-specific than others.
Job description
As HM Chief Inspector you will lead His Majesty�s Inspectorate of Prisons for Scotland in the following:
Ensuring a systematic programme of inspection is carried out and that the standards and guidance for such inspections are maintained.Conducting inspections, including the use of, the Standards for Inspecting and Monitoring Prisons in Scotland; relevant information available from individual prisons and from SPS Headquarters; and request access to any ad hoc data as may be necessary.Inspecting, or arranging for the inspection of, prisons, the treatment of prisoners, the conditions in which prisoners are transported or held in pursuance of prisoner escort arrangements and inspecting the arrangements operated by prisons for the temporary release of prisoners in accordance with rules made under Section 39 of the 1989 Act.Investigating specific matters connected with prisons or prisoners which have been referred to the Chief Inspector by the Scottish Ministers.Issuing instructions to prison monitoring co-ordinators in relation to the exercise of their functions.Supporting the implementation of recommendations of the Independent Review of the Responding to Deaths in Prison Custody and provide oversight of the effectiveness of changes implemented.Reporting to Scottish Ministers, in such manner as the Chief Inspector considers appropriate, on any matter relating to the conditions in prisons, the treatment of prisoners, or the exercise of the functions of prison monitoring co-ordinators or independent prison monitors.Using discretion to assess whether there is an identifiable need or reason to conduct a thematic inspection.Providing an Annual Report to Scottish Ministers and lay a copy of this before the Scottish Parliament.Giving professional leadership and ensuring development of the Inspectorate, always acting in accordance with the highest standards of integrity, transparency, and public accountability.Having regular contact with SPS and keep updated as to SPS policy, research and current issues affecting the Service.Participating and attendance at meetings of the UK National Preventative Mechanism, in fulfilment of the UK�s obligations to the Optional Protocol to the United Nations Convention Against Torture and other Cruel, Inhuman or Degrading Treatment of Punishment (OPCAT).Person specification
