About HMRC Legal Group

Across Legal Group we provide legal services to the whole of HMRC. This includes:


• The conduct of independent reviews of decisions made by HMRC which are requested by customers under the legislative provisions.


• The conduct of tribunal and civil litigation on a full range of services.


• Work on new legislation.


• Drafting of statutory instruments and other legal documents.


• Legal advice to ExCom and staff.

We also provide technical accountancy and forensic services to HMRC, head of the Compliance Accountants' and Insolvency Professions as well as handling Ministerial Correspondence and Freedom of Information requests for HMRC.

The posts are within HMRC Legal Group and specifically within the National Tax Litigation business stream. This business stream works a range of litigation appeals, mainly defending appeals on behalf of the wider department made by taxpayer customers in the Tax Tribunal.

Job description

The Band O Litigators will be expected to develop an acceptable level of knowledge, skills and understanding and work as part of a fast-paced Litigation team but may also be asked to support colleagues in other parts of HMRC Legal Group and the wider HMRC.

Advocacy is an important part of being a litigator and successful candidates will be expected to advocate in the Tribunal.

The successful applicants will be responsible for delivering casework and/or providing support to Litigators on large-scale Litigation projects, depending on where the business need is. The duties will vary depending on the post but will include the following:


• Making decisions about case progression.


• Drafting of applications and notices for the First-tier Tribunal (FTT).


• Correspond with the FTT, Appellant, and their representatives at the initial stages of litigation and when required in future stages of litigation.


• Prepare chronologies.


• Identify relevant documents and produce bundles.


• Presenting hearings on behalf of HMRC at the FTT (in person or via video).


• Draft submissions and other key documents to the Tribunal outlining HMRC's case.


• As a case holder, manage or support all aspects of case management from commencement of proceedings through to hearing and conclusion, ensuring legal deadlines are strictly adhered to.


• Provide support to experienced senior colleagues on complex cases.

Some administrative duties may include:


• Instructing counsel, if necessary.


• Maintaining litigation records utilising a range of case and management information systems where appropriate.


• Ensuring management information presents an up to date and accurate picture of the current litigation picture.


• Ensuring all mandatory case initiation steps are completed.


• Complying with General Data Protection Regulations by following the team litigation case closure and retention process.


• Supporting litigators by completing a variety of litigation support tasks which enables cases to progress effectively and within Tribunal deadlines.


• Manage incoming correspondence from the Tribunal, ensuring all relevant stakeholders are updated and correspondence is filed accurately.

Person specification

Please note that there will be a requirement to undertake extensive training for a period of 24 months. The training will consist of:


• Tax Routeway.


• Litigation Skills Training.


• Full completion of the Quality Assessment Framework.

Please note that we won't be able to provide you with a supervisor for CILEX training.

Essential Criteria

For this post you must have:

  • Experience as a litigator; or
  • Experience of supporting the administration of litigation or reviews (tax, non-tax and benefits & credits); or
  • Operational experience of direct or indirect tax activity; or
  • Legal Qualification - a law degree or a Tax or accountancy qualification.

Moves Adjustment Payment will be available for this role, provided the successful applicant is a current HMRC colleague in Bradford and meets the eligibility requirements outlined in the HMRC's Moves Adjustment Payment guidance.
