About the Role:

The Devon County Council is seeking a highly skilled and experienced individual to fill the position of Mental Capacity Act Practice Lead. This role is a key part of our Integrated Adult Social Care Directorate and will play a crucial role in driving practice change and improvement in the application of the Mental Capacity Act.

Key Responsibilities:

  • Work closely with frontline staff to develop and enhance excellent practice for individuals who may lack capacity in relation to decisions around their care and support.
  • Ensure that the council meets statutory requirements and that local policy, guidance, procedures, and protocols are clear, helpful, and applied in all areas of Mental Capacity Act activity.
  • Analyze practice and performance data to identify strengths and weaknesses in operational practice.
  • Conduct quality practice reviews, provide feedback, support, and monitor improvement where required.
  • Support the design, development, and review of learning and development programs, liaising with partner agencies as necessary.
  • Provide expert advice and guidance to staff on the requirements of policy and the application of the Mental Capacity Act.
  • Engage with the County Solicitor and other professionals to ensure that practice meets current legal requirements and to facilitate applications to the Court of Protection as needed.

About You:

To be successful in this role, you will need to be a registered Social Worker, Nurse, or Occupational Therapist with a strong passion for the Mental Capacity Act. You will have a sound knowledge of the Act, including its interface with other statutory frameworks, and the ability to understand and disseminate the impact of developing case law on practice.

You will have experience of managing people and a proven ability to drive change. You will be able to use coaching-type skills to support staff in developing their practice and have good communication skills across all mediums. This role requires the ability to fulfill all spoken aspects of the role with confidence and fluency in English.
