WORKING HOURS: Full-time, 9:30am – 5:30pm, Monday to Friday with a one-hour lunch break. Flexibility in working hours is essential, and additional hours may be necessary during peak periods.

The team collaborates with leading creative agencies, production houses, advertising firms, managers, and both national and international celebrities, as well as prominent brands in sectors such as fashion, beauty, leisure, hospitality, consumer goods, music, and technology.

ROLE DESCRIPTION

We are looking for an Associate with a specialization in commercial intellectual property to join our team. The ideal candidate will have experience in the media, entertainment, beauty, fashion, and social media sectors, with a background in both commercial and contentious intellectual property matters.

The successful applicant should demonstrate flexibility and a keen interest in engaging with a variety of projects focused on 'soft-IP'. The nature of our work often places us at the cutting edge of the industries we serve, necessitating a candidate with a proactive and innovative approach to meet the creative and commercial demands of our diverse clientele.

The candidate must possess a solid understanding of commercial intellectual property issues and be adept at managing related contentious matters as they arise.

This role involves significant client interaction, and the candidate will be expected to collaborate effectively with team members and other departments within the firm, delegating tasks as appropriate while building and maintaining client relationships with guidance from senior partners.

KEY RESPONSIBILITIES

  • Providing counsel on commercial intellectual property matters related to content, including the production, exploitation, and distribution of various media (both digital and traditional), and drafting relevant agreements such as podcast contracts, content licensing, distribution agreements, and production contracts.
  • Advising on brand strategy, protection, and licensing, including drafting applications and agreements related to trademarks and co-branded ventures.
  • Drafting commercial contracts for advertising and marketing campaigns across multiple platforms, including digital, linear, and event-based initiatives.
  • Offering regulatory advice on advertising, including compliance with digital regulations, online safety, and relevant industry codes.
  • Consulting on publishing and media matters.
  • Advising on sponsorship agreements, including celebrity endorsements and influencer marketing, and drafting associated contracts.
  • Providing guidance to talent managers and agencies regarding contracts and business dealings with talent.
  • Advising talent on business ventures, image rights, and service agreements.
  • Consulting on shareholders' rights in brand-related transactions, collaborating with corporate teams for transaction support.
  • Managing supply chain agreements for goods and services, including merchandise production and e-commerce arrangements.

CONTENTIOUS MATTERS

  • Handling brand enforcement and prosecution, including drafting cease and desist letters for intellectual property infringements and collaborating with litigation teams.
  • Advising on domain name disputes and managing related proceedings.
  • Engaging in dispute resolution for breach of contract matters, including drafting pre-action letters and advising on settlement strategies.
  • Managing reputation-related issues for brands and talent, including trademark infringements and defamation cases.

QUALIFICATIONS & EXPERIENCE

The successful candidate should possess the following:

  • A minimum of 3-6 years of post-qualification experience in reputable law firms.
  • A methodical approach with a strong emphasis on accuracy.
  • Excellent written and verbal communication skills, with experience engaging with senior stakeholders.
  • A professional demeanor, resilience, and a commitment to exceptional client service.
  • Strong organizational skills, with the ability to prioritize and manage a substantial workload under pressure.
  • Confidentiality and discretion in all matters.
  • Willingness to work outside regular hours during busy periods.

EDUCATIONAL REQUIREMENTS

  • Qualified Solicitor in England and Wales.
