As a Court of Protection Solicitor, you will play a crucial role in safeguarding and protecting the rights and interests of vulnerable individuals who lack the mental capacity to make decisions for themselves, as well as assisting those who act on their behalf.

You will be the department expert in cases relating to the wellbeing of individuals who lack capacity, including health and welfare, financial issues, and mental capacity. You will provide technical expertise and guidance to other team members, ensuring that all matters are handled within specified timeframes and with a high level of professionalism.

Key Responsibilities:
  • Provide expert advice and representation to clients in Court of Protection cases, including applications for deputyship, statutory wills, health and welfare decisions, and related trust matters.
  • Prepare and review legal documents, including court applications and financial reports.
  • Run deputyship cases.
  • Manage cost applications.
  • Deal with matters relating to nursing or residential home funding.
  • Deal with deprivation of liberty and safeguarding matters.
  • Comply with file management procedures.
  • Stay updated on changes in legislation and case law related to the Court of Protection, ensuring compliance and the provision of accurate advice.
  • Have a professional, proactive approach, strong client care skills, and be interested in business development and marketing to supplement the substantial work volumes brought in by the firm.
  • Take on additional tasks as reasonably required by the Head of Wills, Probate, Tax & Trusts.
Requirements

To be successful in this role, you will need to have:
  • A qualified Solicitor or Chartered Legal Executive with a minimum of 3 years' experience running your own Court of Protection caseload.
  • Strong knowledge and understanding of the Mental Capacity Act 2005 and associated legislation.
  • Proven experience in managing a caseload of Court of Protection matters.
  • Excellent analytical, research, and problem-solving skills.
  • Exceptional verbal and written communication skills, with the ability to communicate complex legal concepts to clients and stakeholders.
  • Strong advocacy skills and experience representing clients in court.
  • A high level of professionalism, integrity, and ethical conduct.
  • The ability to work independently, prioritize tasks, and meet deadlines.
