Position Overview

The role of the Commercial and Contracts Analyst is vital in enhancing the IT Commercial function by evaluating commercial agreements, ensuring adherence to regulations, and streamlining the contracting and delivery processes. This position necessitates collaboration with various teams to refine contract terms, reduce risks, and improve overall business efficiency.

Key Responsibilities

  • Examine commercial agreements, including contracts, proposals, and modifications, to guarantee precision and compliance with organizational policies and legal standards.
  • Engage with internal departments, such as legal and procurement, to draft, review, and negotiate requirements, program documentation, and contract stipulations, ensuring they align with business goals.
  • Assess pricing models, payment conditions, and other commercial elements of contracts to uncover opportunities for value enhancement and risk reduction.
  • Contribute to the formulation and execution of contract and vendor management policies to optimize processes, boost efficiency, and ensure compliance.
  • Collaborate with service delivery and project teams to oversee the daily execution of contracts, ensuring effective performance management through service level agreements (SLAs), experience level agreements (XLAs), and key performance indicators (KPIs).
  • Conduct market analysis to remain updated on industry trends, benchmarks, and best practices concerning commercial and contractual issues.
  • Assist in preparing Terms of Reference, Pre-Qualification Questionnaires (PQQ), Invitation to Tender (ITT), and other commercial and project documentation, ensuring alignment with corporate strategies and client needs.
  • Maintain precise and current records of contracts, amendments, and associated documents.
  • Work with vendors and clients to address inquiries, resolve issues (including contracts, procure-to-pay, vendor management, disputes, etc.), and negotiate changes to existing agreements.
  • Keep an obligations tracker and perform regular audits of compliance with contract obligations.

Technical Expertise

  • Contract Analysis: Skilled in analyzing and interpreting commercial agreements, comprehending terms and conditions, and identifying potential risks. Experience with IT and Utilities contracts is preferred.
  • Negotiation Skills: Capable of effective collaboration during negotiations, ensuring contracts align with business objectives while fostering positive relationships with stakeholders and suppliers.
  • Financial Acumen: Proficient in financial principles and capable of evaluating pricing structures, payment terms, and the financial implications of contracts.
  • Financial Systems: Familiarity with procure-to-pay systems for order placement and supplier payments.
  • Contract Management Systems: Knowledge of contract management software or similar tools to maintain organized and accessible commercial records.
  • Market Research: Competence in conducting market research to stay informed about industry trends and best practices.
  • Communication: Strong written and verbal communication skills to effectively engage with internal and external stakeholders.

Qualifications

  • Degree in Business, Finance, or a related discipline, or an equivalent qualification.
  • Experience in contract analysis, procurement, or a related field.
  • Understanding of contract law and commercial terms is desirable.
  • Additional certifications in contract management or related areas are advantageous.
