Introduction

As claims executive you may be involved in the following tasks:

- Handle cargo claims (pre claim / quantified claim)
- Review agency contracts
- Pursue recovery against local third party
- Handle Freight and D&D recovery
- Assist Head Office Legal Dpt cargo claim teams in any tasks

MAIN PURPOSE

As claims executive you will be in charge of handling claims presented in relation with the company activities, as well as to provide support and advice to operational and commercial teams and protect the company against legal risks and violations.

MAIN RESPONSBILITIES
- Resolving operational issues experience in case of alleged or confirmed cargo damage.
- Investigating the cause of damage to cargo and CMA CGM assets and equipment.
- Assessing legal liability for damage in order to allocate and potentially recover costs as appropriate.
- Working closely with your managers, and within the authority granted, you may also negotiate settlements with plaintiffs and third parties
- Taking action to protect CMA CGM’s interests and recovery prospects.
- Sending notice of liability and seeking recovery of costs incurred by CMA CGM from liable third parties.
- Rebutting claims for cost reimbursement from third parties.
- Keeping accurate records of all matters and all elements of cost incurred.
- Monitor the financial data of your files by accurately using the in-house IT systems and provide reports.
- Working alongside the HO claims team and CMA CGM legal network to ensure potential claims against CMA CGM are mitigated, especially with regard to cargo and personal injury claims.
- Assist the HO claims team, CMA CGM legal network or CMA UK management in the handling of cargo claims and in other legal matters.
- Developing and maintaining strong cross departmental relationships.
- Liaising and forming strong relationships with CMA CGM UK departments as well as Head Office, customers, suppliers and third parties locally and worldwide.
- Liaising with CMA UK cargo surveyor and lawyers, provide visibility on their appointments/invoices and challenge the quality of the services provided.
- Liaising with all parties involved in the claims process including cargo interests, vessel owners, P&I Clubs, charterers and insurers.

SKILLS & EXPERIENCE
- Able to identify and assess options, perform cost analysis and think creatively to solve problems.
- Able to take a co-operative and sympathetic approach and provide a high level of customer service.
- Confident making decisions and working tactically.
- Strong team player.
- Excellent communication skills demonstrating clarity of reasoning and appropriate style.
- Excellent organisation & prioritisation skills and good attention to detail.
- Experience in Maritime Law desirable to be able to assess liability and understand limitations, contractual relations, Charter parties, Bill of lading and possible defences.
- Determined, tenacious and persuasive.
- Professional under pressure and in the face of dispute.
- Able to self-manage workload and performance.
- Able to collate and analyse information.
- Able to draw conclusions as to facts and liabilities.
- Able to keep detailed and well-ordered records.
- Excellent IT user capable of working across multiple IT systems (Microsoft Office + In house systems).
- Previous Claims, Legal or dispute resolution experience preferable.

PRACTICAL & TECHNICAL KNOWLEDGE
- Good knowledge of cargo claims desirable.
- Strong understanding of container handling operations at terminals and depots.
- Strong understanding of logistics and multimodal transport.

QUALIFICATIONS
- Minimum of GCSE grade C or above in English and Mathematics or equivalent
- Maritime Law degree essential.
