The Mental Capacity Act 2005 is a law about making decisions and what to do when people cannot make some decisions for themselves. Individuals might be able to make some decisions but not be able to make other decisions. When a person cannot make a decision, this is called lacking capacity. Sometimes a person lacking capacity may want to do something that is not in their best interest, and they may need preventing from doing this. This is called a Deprivation of Liberty. A Person’s Representative is there to support the relevant person during their time in hospital or care home while they are deprived of their liberty. We require RPRs to visit the person regularly to make sure their interests are being upheld and safeguarded.

**Working with**: The Board of Trustees, staff, and clients of Family Welfare and colleagues in both statutory and non-statutory agencies and key stakeholders.
**Location**: Office base - Family Welfare, 1st Floor, Adult Learning College, Walmesley Road, Leigh, WN7 1XN
- To act as a paid RPR, as described in the Mental Capacity Act 2005 (MCA), its Regulations and Code of Practice.
- Working throughout the Wigan borough with people according to agreed criteria.
- To carry a caseload of clients
**Remuneration**: The post holder will be paid £24,000 per annum for undertaking this role
**Hours**: Full time: 37.5 hours per week.
**Duties**
- To help the client to understand the DOLS authorisation and ensure that their rights are upheld.
- To provide clients, where necessary, with accurate, up-to-date information taking due consideration of relevant legislation including the Mental Health Act, Mental Capacity Act, Deprivation of Liberty Safeguards, Care Act and associated statutory guidance and code of practices.
- To visit clients every 10-12 weeks
- To represent the views, needs and rights of clients on a formal and informal basis to others involved in their life and care.
- To note all conditions attached to the authorisation are met and if not, to challenge.
- Maintain contact with the person deprived of their liberty by visiting on a regular basis as requested.
- To use formal and informal complaints procedures where needed.
- Request a review of the DOLS authorisation if appropriate.
- To write regular reports, highlighting any issues or concerns, sending these to the Supervisory Body.
- If necessary and where possible challenge the authorisation through local means or ultimately, refer the case to a recognised specialist solicitor for consideration of escalation for Court of Protection challenge.
- To maintain accurate, up-to-date reports and case records on Family Welfare’s case management system.
- To support the advocacy team by covering admin and phone duties, where required.
- To be conversant with the administrative processes, policies and procedures of Family Welfare.
- To attend training courses, supervision sessions and team meetings as required.
- To hold a large caseload due to the infrequency of visits.
- To pass on all cases that are deemed in need of challenge.
