Band 5 - Full Time Mental Health Legislation Administrator

An opportunity has arisen for a Mental Health Legislation Administrator to work atMHL Office,Newbridge House. Applicants must have obtained a Certificate in Mental Health Law and Practice or have at least 3 years’ experience of working as a Mental Health Legislation Assistant within an Acute/Specialties setting.

It is essential that the applicant has experience of working with the Mental Health Act and Mental Capacity Act, can scrutinise legal documentation, can work using their own initiative, can demonstrate effective written and organisational skills. The ability to prioritise workload and process enquiries in a confidential and timely manner is a must.

The post holder will be responsible for the provision of management of the MHL Assistants, within the Department, including the management and effective operation of recruitment, appraisal, supervision and training.

Applicants must be able to work well under pressure, deal with sensitive information and complex situations that at times can be challenging in a calm and professional manner.

To administer and manage the MHA in accordance with statutory requirements, including MHA Reviews - Tribunals and Lay Managers - within the required timescales and statutory guidelines. To complete MHA audits and research as and when required.

To administer the Mental Capacity Act (MCA) and Deprivation of Liberty Safeguards (DoLS) and any proceeding legislation - on behalf of the Trust.

To be responsible for the management of MHL Assistants, to include facilitating RMS, authorising leave via ESR and managing sickness etc.

To provide MHA receipt and scrutiny training to qualified nursing staff on monthly basis.

The MHLA, must be familiar with the requirements of the Tribunal and the procedural rules and Practice Directions by which it operates. The rules place a statutory responsibility on the MHLAs to provide the Tribunal with a statement of authority (relevant facts) together with certain reports.

The MHLA must ensure that Trust procedures are followed to ensure RCs are reminded of their statutory requirements under the MHA 1983.

The post holder is expected to work flexibly to ensure that a high quality MHL administration and support service is maintained at all times.

The post holder will be responsible for the provision of management of the MHL Assistants within their remit, including the management and effective operation of recruitment, appraisal, supervision and training.
