Deputy Head of Legal Services

Main Duties and Responsibilities Support the Head of Legal Services in the development of policy, processes and systems for the management of inquests and claims to ensure claims are effectively managed in accordance with the Trusts Claims Policy, NHS Resolution Scheme Rules, Civil Procedure Rules, Pre-action Protocols and Coroners Rules, to minimise financial, reputational and other risks to the Trust. Manage a specific workload in relation to inquests that are a cause for concern. Identify lessons learned from individual claims and inquests as themes, trends and patterns, working closely with key senior managers to advise and implement solutions and plans to prevent future harm, loss or damage. Assist claims handlers and legal representatives dealing with Trust claims, arranging and attending meetings with relevant staff and obtaining other relevant information including personal records, clinical records, clinician and manager views and Trust policies and SOPs.
Communications and Relationships Work with managers across teams to ensure that matters that may become contentious inquests are identified and handled effectively from an early stage. Deputise as the Trust contact between the Coroner and the Trust when the Head of Legal Services is unavailable, and ensure all inquests are effectively prepared for and that all Trust staff are appropriately supported. Work closely with the Trusts solicitors and NHSR claims handlers, escalating concerns to the Head of Legal Services where appropriate (including in relation to highly complex cases) and ensure the Trusts views are made clear. Analytical and Judgemental Skills Monitor the quality and quantity of data and information, escalating concerns to the Head of Legal Services and taking the necessary actions to deal with any problem.
Monitor outcomes from inquests, ensuring that these are disseminated, reviewed and responded to within agreed timescales. Assist in the production of reports relating to inquest management and outcomes. Planning and Organisational Skills Ensure that contentious and potentially contentious inquests are escalated to the Head of Legal Services effectively to reduce risks to the Trust, including associated claims and adverse publicity. Assist the Head of Legal Services to ensure that disclosure requests from Coroners are responded to in a timely fashion by the inquest leads.
Assist with the daily management, development and monitoring of the processes and systems for inquest Assist with the monitoring the inquest and claims modules for the Datix system, specifically ensuring that inquest and claims data is recorded accurately and reported in line with national and local standards. Physical Skills Ability to travel between hospital sites and externally Responsibility for Patient Care Support the Head of Legal Services with the development and implementation of systems for ensuring that feedback and learning from claims, investigations and inquests is effectively shared across the organisation Actively support and promote a transparent and learning culture across the Trust including supporting the Divisions to develop systems for providing feedback to staff from investigations related to inquests and claims. Responsibility for Policy/Service Development Support the development of managers across the organisation to ensure that inquest and claims management systems and processes are understood and implemented. Assist in the development and quality assurance of Trust-wide inquest training.
Responsibilities for Financial and Physical Resources Work within agreed budget targets and assist the Head of Legal Services in identifying changes in service delivery to release agreed efficiency savings. Work collaboratively with the senior management team in the directorate in the preparation of bids for financial resources Responsibilities for Human Resources Provide management support to the Legal Services team across all care organisations. Manage the staff resource in the absence of the Head Of Legal to ensure that service delivery is maintained and the objectives of staff within the team are met. Manage staff in line with Human Resource policies to support their ongoing development and performance review e.g.
attendance, annual leave, attendance at mandatory training and other training courses to support their personal development and undertaking annual appraisals. Facilitate regular team meetings in the absence of the Head of Legal Services, to ensure effective communication within the team. Ensure communication and working relationships are effective and underpin staff involvement in all complexities and levels of decision making. Provides and receives highly complex information and anticipates barriers to communication, whilst recognising factors that may influence the situation and pro-actively seeking out solutions to improve communication.
