An exciting opportunity has become available for an interim Head of Legal Services, on a short term fixed contract for 6 months who will be responsible for leading the provision and management of a dedicated in-house legal advice service within the Quality Governance Team at Royal Berkshire NHS Foundation Trust.

You should have significant experience of working in the legal field of healthcare in the NHS including the management of negligence claims and inquests. You will need excellent communication skills, and the ability to negotiate and communicate complex and contentious issues and information.

- Lead the investigation and management of clinical and non-clinical Claims, in liaison with instructed solicitors and NHS Resolution (NHSR).

- Lead and manage Legal Services, working with the teams to set the standards and drive improvements across the
- Provide authoritative advice on the management of claims to staff within the Trust and ensure that this meets regulatory
- Ensure that lessons are learnt and areas for improvements to the care provided are identified, with actions taken as a result of claims and inquests. Ensure that the Care Groups have systems in place to monitor their performance and to improve services, including regular reporting of actions taken as a result of Claims and
- Pro-actively manage internal and external stakeholders across a range of departments and organisations ensuring effective relationships are developed and
- Advise on the law as it relates to the disclosure of medical records and other documents under Access to Medical Records Act 1990, Data Protection Act 2018 Freedom of Information Act 2000 and Mental Capacity Act
- Provide verbal and written advice on legal matters relating to healthcare to all Trust staff, referring to the Trust’s solicitors when
- Advise on Trust policies and procedures, particularly areas of consent. Deliver training as required to members of Trust
- Ensure Senior Management are appraised of legal issues, including new legislation which may have an impact on the Trust’s activities and objectives.
- Advise the Trust on issues of concern, including media interest and potential reputational risks that arise during investigations/proceedings
- Design and deliver of medico legal programmes, engaging external agencies as necessary. Contributes to the design and delivery of quality and patient safety, governance and compliance training programmes.
- Ensure that all clinical negligence and personal injury claims are investigated and managed efficiently in accordance with Trust policy and procedure and the rules of the NHSR and ENS.
- Ensure all claims are managed in accordance with the Pre-action Protocol and Civil procedure rules from receipt of the Claim until closure. Liaise with claimant’s solicitors, report all letters of claim to the NHSR and prepare preliminary analysis reports where required.
- Maintain an updated claims database on to meet the reporting requirements of the NHSR and internal
- Ensure appropriate claims standards are met in full to ensure compliance with regulators.
- Monitor performance of claims management to ensure compliance with claims policy and provide reports to the Quality Assurance & Learning Committee and Patient Safety
- Ensure the policy and procedures for the management of Claims are reviewed and updated as necessary on an annual
- Provide monthly reports to the Medical Director, Chief Nurse, Deputy Chief Nurse, Associate Chief Nurse, Care Group Governance and Quality Assurance & Learning Committee on all on-going and new
- Ensure that appropriate and effective methods of communication are in place to alert the Trust Executive Team and Director of Communications to any risk/publicity exposed by a Claim or Inquest.
- Undertake audits to demonstrate effectiveness of the policy and management of Claims.
- Support the development of a new claims management system/culture to reflect any changes in the requirements of NHSR or other external
