Acorn Recruitment are looking for a Claims and Inquest Manager on behalf of a renowned Trust. The role is based in Exeter but travelling over multiple Trust sites would be required.
The successful Claims and Inquest Manager will provide specialist advice and guidance on all aspects of claims, inquests, and litigation.
Roles and Responsibilities:

- Support the Senior Claims and Inquests Manager in managing the Trust's Claims/Inquests function to ensure claims are effectively managed in accordance with the Trust's Claims Policy, Scheme Rules, Civil Procedure Rules, Pre-action Protocols and Coroners Rulesto minimise financial, reputational and other risks to the Trust
- Ensure that the financial implications of the Trust's claims position are communicated to the Finance team on a regular basis
- Work closely with the Trust's solicitors and claims handlers, challenging their decisions where appropriate (including in relation to highly complex cases) and ensure the Trust's views are made clear
- Promote the prevention of claims and minimise associated costs to the Trust by identifying the appropriate support, information, training, and development that will enable learning
- Identify lessons learned from individual claims and legal issues as well as themes, trends and patterns, working closely with key senior managers to advise and implement solutions and plans to prevent future harm, loss or damage
- Assess all new potential and actual claims by investigating and interpreting a range of facts to identify whether any breach of duty may have occurred and assess liability. These can range from complex to highly complex and/or contentious facts and situationsrequiring sensitive handling, especially when relating to clinical negligence claims potentially leading to significant compensation
- Assist claims handlers and legal representatives dealing with Trust claims, arranging and attending meetings with relevant staff and obtaining other relevant information
- Work with managers across the Directorate and Information Governance teams to ensure that matters that may become contentious inquests are identified and handled effectively from an early stage
- Represent the Trust at Pre-inquest Review Meetings and inquest hearings. With cases involving highly sensitive and complex clinical situations, a significant level of interpersonal skill is required to support understanding across all parties. A high degreeof preparation will also be required to ensure the Trust is well-represented and its staff supported
- Anticipate issues likely to arise during the inquest hearing and ensure appropriate witnesses, including senior managers, provide reports and/or attend to deal with any points that may arise
- Liaise with Coroner's offices to develop a good understanding of Coroner working practices across the Trust's area and build strong working relationships
- Ensure staff involved in difficult and highly contentious inquests, are supported in accordance with the Trust's Policy on Supporting Staff Involved in Adverse Incidents, Complaints and Claims
- Prepare accurate and detailed responses to Prevention for Future Deaths reports received by the coroner. This will involve meeting with key personnel, reviewing complex documents and interpreting the information in an appropriate format to respond to thecoroner's concerns
- Ensure that learning from inquests and Coroner's recommendations is captured and fed back to the appropriate function within the Trust in order that appropriate plans can be put in place
- Ensure the Trust's Claims Policy and associated procedures remain up to date and compliant with legal obligations, national guidelines, and best practice
- Deputise for the Senior Claims and Inquests Manager as required
- Provide resilience for the Senior Claims and Inquests Manager where required
- Research new legislation for relevance, highlighting implications for the Trust
Essential Experience and Qualifications:

- Qualified Solicitor, Barrister or Chartered Legal Executive entitled to practice in England and Wales
- Evidence of Continuing Professional Development (including post-graduate training whilst in employment)
- Able to meet the Knowledge and Skills Framework for the role
- Significant experience in a similar or relevant role and/or post-qualification experience working as a solicitor, barrister or legal executive
- Significant experience of employer's liability and clinical negligence litigation
- Advocacy experience
- Experience of producing complex letters and reports. Understanding of the principles of investigation techniques
- High level of knowledge of tort law principles and the legislative framework underpinning claims and inquest processes
- High level of written and verbal communication skills
- Good negotiating skills
- Excellent organisational and presentation skills
Desirable Experience and Qualifications:

- Health law qualification
- Management qualification
- Valid practicing certificate or equivalent
- NHS or local government experience
- Experience of managing inquests
This post is a temporary position, for initially 3 months.
Working hours are 37.5 hours per week and hours are as per rota.
Pay Rate:
For the first 12 weeks: £16.97 per hour
After 12 week period: £20.49 per hour
