Interim Planning Obligation Monitoring Officer Reference no: Merton 5251551 Pay Rate: £28.11 per hour PAYE 35 Monday - Friday, normal working hours This opening assignment is for 3 months City: MORDEN, LONDON Must be able to attend the office x3 days per week Make a significant contribution to the regeneration of the borough through the planning for and provision of infrastructure by leading on collecting, administering and spending of planning obligations to ensure that growth and regeneration is delivered in line with corporate priorities.
Manage the operation and further development of the council’s monitoring systems including recording of S106 Agreements and their details and other relevant funding streams, track the progress of agreements and application of financial contributions, ensuring that contributions are collected and effectively applied and in-kind benefits effectively delivered.
The role will have responsibility for supervising staff within the team such as training new starters on CIL and S106 processes and leadership responsibilities on technical and project collaborations with other sections in the council and external stakeholders in maximising the outcomes of S106 agreements and CIL investment on infrastructure and communities affected by development.
Deal with matters relating to Section 106 of the Town and Country Planning Act in the context of area and infrastructure growth and development, and work with services across the council, to maximise inward investment to support economic development and wider regeneration objectives.
Alongside the Principal Planning Contributions Officer and Development Management case officers, team leaders and managers to lead on the technical, financial and legal procedures associated with all aspects of securing, delivering and maximising the benefits of planning obligations in Merton.
Organise, maintain and develop technical improvements to a system of regular monitoring and administration of the implementation of S106 planning obligations
Contribute technical knowledge and expertise within regeneration, planning, and other related fields and direct technical and specialist resources, assist and provide advice to managers, Development Management and legal officers in their negotiations and monitoring of the progress of S106 obligations and the use of S106 financial contributions.
Be solely responsible for making planning-related technical judgements, advice, expert witness statements and recommendations on competing needs and development delivery mechanism, including designing bespoke policies and guidance notes, conditions and obligations to optimise benefits for Merton.
Undertake leadership roles on behalf of the team in maintaining effective liaison arrangements between representatives of all Council departments, Members and developers in relation to the securing, delivery and monitoring of S106 obligations. Support the team and CIL Collection Officers in the effective administration of the Community Infrastructure Levy from time to time
Support enforcement action relating to S106 and CIL, including stop notices, injunctions and legal action. To be lead instruction officer in the engagement of the Council’s legal counsel as required in respect of legal action relating to S106 and CIL.
Represent the Council as expert witness on specific technical planning matters at public enquiries, appeals and court hearings as required (e.g. recovery and injunction hearings and judicial reviews.)
