Where: Nationwide - This position provides the flexibility of a hybrid working arrangement, allowing employees to balance their work responsibilities between remote and on-site at one of our regional business office locations.

Main duties of the job

At Change Grow Live, we are committed to continually finding ways to improve the safety, effectiveness and quality of the services we offer as well as the experiences of those who use and deliver them. Our Safeguarding and Quality Improvement Team, part of the wider Assurance Team, play a vital role in using data, evidence and insight to drive local and national improvement initiatives, including the continual improvement of safeguarding and MCA practice. The team will work collaboratively with colleagues across Change Grow Live, ensuring that the experiences of those that use and deliver our services are central to the improvements we make.

The Mental Capacity Act (MCA) Business Partner will report to the National Safeguarding Manager and will ensure compliance with legal and ethical principles outlined in the MCA 2005, safeguard the rights and wellbeing of individuals lacking mental capacity, and provide guidance and support to staff in decision-making processes within our organisation.

The Mental Capacity Act (MCA) Lead will occupy multiple spaces, building wide networks with people who use our services, external partners and agencies as well as internal colleagues. They will have a key role within the Assurance Team and will work closely with colleagues across the organisation to deliver team and organisational priorities. They will be influential members of Change Grow Live, helping to embed a culture of learning and improvement across the organisation.

Job responsibilities

Lead on the national development, delivery and implementation of Mental Capacity Act (2005) across Change Grow Live.

To work with the National Audit Manager to ensure regular audits of the MCA (2005) within Change Grow Live, preparing reports of any findings and recommendations.

Provide expert advice, support and guidance around the MCA (2005) to local and regional teams across Change Grow Live.

Facilitate local and national spaces and forums for collaboration and learning, developing high levels of awareness, knowledge and confidence in relation to MCA.

Provide coaching and development opportunities within services.

Work closely with colleagues in L and D to ensure a suitable, regulatory compliant and up to date package of mandatory and role relevant learning is available for all roles across the organisation.

Support the development and implementation of MCA policies, procedures and new ways of working.

Work closely with members of the wider Assurance Team to ensure that the MCA (2005) is well embedded in practice locally.

Work closely with Data Business Partners to analyse and interpret information and data, presenting this in a variety of local/regional forums and facilitating sense-making, identification of risk and development of improvement plans.

To provide expert advice, support and guidance in relation to the Deprivation of Liberty safeguards (DoLS)

Support the work of specific workstreams as set out in the Assurance Directorates Business Plans.

Represent the Safeguarding and Quality Improvement Team and wider Assurance Team, providing expert input into a range of local, regional and national forums and groups.

Provide regular updates to the wider organisation in relation to the MCA (2005) and any changes in law.

Represent the Safeguarding Manager when appropriate, including during periods of absence.

Work collaboratively with colleagues across Change Grow Live to support the implementation of good MCA practice in all that we do, ensuring that the experiences of those who use our services and those who deliver them shape practice.

Experience of leading on the delivery of the Mental Capacity Act (2005) and the Deprivation of Liberty Safeguarding (DoLS). Experience of working collaboratively with multi-disciplinary teams. To confidently facilitate forums for collaboration, learning and sharing of good practice. To work collaboratively across your team and the wider organisation to deliver on overseeing the Mental Capacity Act (2005) Excellent time management and prioritisation skills. Effective communicator with the ability to negotiate, influence, challenge and support and generate confidence, trust, and respect at all levels of the organisation. Ability to work collaboratively to design, develop and deliver relevant training packages. Use expertise, experience, data and evidence to equip services with information, knowledge, tools and support; enabling them to lead their teams to deliver safe and effective services. Able to demonstrate sound judgement based on evidence, knowledge and understanding. Good analytical skills to assess, interpret and present data.
