Associate - Forensic Investigators - Enforcement & Market Oversight Division (12-month FTC)

The Role

The Wholesale departments conducts investigations into regulatory breaches and criminal offences by firms and individuals operating in the wholesale arena. Typical cases include insider dealing, market manipulation, misleading statements and systems & controls failings in authorised firms.

In this role, you will have responsibility for investigating and taking action against serious misconduct in financial markets. This ranges from conducting investigative interviews to contentious regulatory and criminal proceedings. You will gain experience of leading areas of investigations and also work as part of a larger, multi-disciplinary team.

Key roles & responsibilities:

- Taking on differing degrees of responsibility for cases depending on their nature and complexity.
- Reviewing material already held and analysing complex data from numerous sources which may include company documents, financial statements, banking material, digital material, to identify appropriate lines of inquiry
- Ensuring the effective progression of cases in order to reach timely outcomes.
- Obtaining evidence through the use of appropriate tools and powers.
- Exploring detailed evidence and making recommendations.
- Preparing for, and presenting cases at, internal case committees when required.
- Building and maintaining effective working relationships with colleagues in other areas within the FCA and with external bodies.
- Attending court to give evidence as required.

Minimum
- Experience in any of the following areas: financial markets; investigations involving serious fraud or other complex financial crime; regulatory investigations; complex litigation or disputes
- Forensic Investigator: Proven investigative experience in financial services and/or complex financial crime

Essential
- Ability to analyse complex evidence to form a view as to what action is warranted, what further evidence may be required/available and how it might be obtained
Strong communication skills in order to present the outcome of that analysis clearly and effectively, orally and in writing
- Ability to make timely decisions based on relevant analysis, exercising judgement on the evidence and being able to defend those judgements where appropriate
- Be able to identify key risks and demonstrate a creative approach to cases
- Current experience of the legal obligations under Data Protection Act 2018 and Criminal Procedure and Investigations Act 1996
- Ability to draft a wide range of documents and correspondence
- Experience of, or demonstrable ability to, conduct interviews and/or take witness statements
- Strong relationship management skills to build and maintain effective working relationships with colleagues in other business units and with external bodies
- Possesses ability to thrive in a varied multi-project caseload, maintaining appropriate progress across a portfolio of projects and workstreams
- Works collaboratively as part of a team, valuing different perspectives and backgrounds, and working with other departments and divisions collaboratively, minimising silos

Desirable
- Experience in financial services investigations involving the FCA
- Familiarity with the responsibilities of, and practices of, the FCA and Enforcement
- Knowledge of the Financial Services and Markets Act 2000 and be familiar with the structures, practices and responsibilities of the FCA and Enforcement, including the process and procedures of the Regulatory Decisions Committee and Upper Tribunal
