Key Responsibilities

In this role, you will significantly enhance the understanding and application of the Mental Capacity Act and the Deprivation of Liberty Safeguards (DoLS) within our organization. Your responsibilities will include:

  • Balancing an individual's right to self-determination with their right to safety, ensuring responses are appropriate and proportionate.
  • Making informed, independent decisions regarding best interests within the context of a DoLS assessment.

As a Capacity Assessment Specialist within our DoLS team, you will evaluate whether residents who lack the capacity to consent to their care are experiencing a deprivation of liberty. If such deprivation is identified, you will assess whether it aligns with their best interests, focusing on risk reduction and harm prevention. Your duties will encompass conducting comprehensive person-centered assessments and preparing all necessary documentation, ensuring adherence to the DoLS legal framework as outlined in the Mental Capacity Act 2005, the Deprivation of Liberty Safeguards (DoLS), Code of Practice, and relevant case law.

The Adults First Contact Service - Safeguarding, DoLS, and General Duty

Our established DoLS team of Capacity Assessors conducts assessments on behalf of the Borough, leading to Standard Deprivations of Liberty under the Mental Capacity Act. We have launched a new Adults First Contact Service aimed at enhancing access and improving the resident experience. This team will focus on the strengths and abilities of individuals, screening for safeguarding, deprivation of liberty safeguards, or Care Act eligibility. Our goal is to provide information and advice that supports the independence of our residents.

Job Duties

- Fulfill the role of Capacity Assessment Specialist in accordance with legislation, case law, and local policy, completing all supporting assessments within statutory timelines as outlined in the Deprivation of Liberty Safeguards (DoLS).

- Gather, evaluate, and analyze complex evidence and differing perspectives, weighing them appropriately in decision-making. You will identify and act upon proposed deprivations of liberty, assessing whether they are in the best interest and submitting relevant reports to the Supervisory Body or Court of Protection.

- Collaborate with ASC Teams to monitor practices, ensuring compliance with recommended conditions in accordance with legislation and case law, conducting timely reviews and renewals of existing DoLS and CoP authorizations, and maintaining effective communication with Managing Authorities.

- Maintain comprehensive and accurate case records, producing high-quality reports and correspondence for various audiences, including but not limited to court, meetings, panels, conferences, and other agencies.

- Take responsibility for decisions and judgments made while performing the duties of the role, presenting cases at legal hearings and exercising appropriate independence, authority, and autonomy to inform practice, alongside consultation and supervision.

- Make suitable recommendations regarding the appointment of Relevant Persons Representatives in line with legislation and escalate any objection cases to the Court of Protection as per case law.

- Demonstrate a strong commitment and comprehensive understanding of mental capacity, deprivation of liberty, and safeguarding through your practice, including critical reflection and analysis of challenging cases, awareness of current issues, and evidence-based research.

- Utilize this knowledge to provide professional support, education, advice, and guidance to staff across various agencies and the public.

- Assist in supporting staff to develop skills and expertise in mental capacity, deprivation of liberty, and safeguarding, providing coaching and mentoring as needed. Maintain effective liaison with other statutory and voluntary agencies, as well as Council departments, ensuring Managing Authorities are aware of their responsibilities in preventing unlawful deprivation of liberty.

- Although not a budget holder, you will be expected to contribute to the effective management of the team's budget.

- Collaborate closely with other staff, professionals, and agencies across the service area, including police, health, providers, and the voluntary sector. The Council aims to deliver services more cost-effectively, which may require employees to adapt to new working methods and locations based on job needs.

- Manage complex and challenging casework while working efficiently, with supervision and support provided as necessary.

Qualifications

Essential

  • Must be a Qualified Capacity Assessor, registered with the Health and Care Professions Council Registration (HCPC) / ASW/AMHP or possess a Practice Teaching award and/or Social Work England registration.

  • Candidates should have successfully completed an approved Capacity Assessment course and demonstrate extensive knowledge and practical experience aligned with the Care Act 2014 and the Mental Capacity Act 2005, along with familiarity with broader legislation relevant to the work of Capacity Assessors in the health and social care sector.
  • Experience in conducting assessments for vulnerable adults with complex needs.
  • Proven experience in undertaking assessments and presenting cases in court.
  • Ability to provide professional support, education, advice, and guidance to staff across various agencies.
  • Excellent communication skills, capable of effectively conveying key and complex information to all levels of staff and adapting communication styles as necessary to ensure understanding.
