Associate Level 8 (Regulatory) to train as an Accredited Financial Investigator - Enforcement and Market Oversight (EMO)

The Role

The purpose of the role is to undertake investigations under all aspects of the Proceeds of Crime Act 2002 (“
_POCA_”) and associated legislation.

You must be willing to be trained as an Accredited Financial Investigator, committing to the independent study and attendance at all relevant training courses necessary to successfully qualify. These training courses may be away from London and may be residential. This post requires the holder to have already successfully completed, or to achieve successful completion of, national security vetting to Security Check (“SC”) level.

You must satisfy either of the following criteria:

- already hold current accreditation with the National Crime Agency as a Financial Intelligence Officer; or
- have previously held accreditation through the National Crime Agency as a financial investigator / confiscator (Parts 8 and 2 POCA) and be currently working in a financial crime investigatory role.

The key responsibilities of the post holder will be:

- Responsibility for conduct of confiscation investigations under POCA, ancillary to criminal investigations conducted by our Enforcement colleagues, typically, but not exclusively in connection with individuals suspected of insider dealing and/or unauthorised activities, using POCA Part 2 and Part 8 powers as appropriate;
- Undertaking civil recovery investigations under POCA Part 5, using investigative powers as necessary and appropriate;
- Analysing and presenting financial data to trace / show the extent and whereabouts of criminal benefit, realisable property, recoverable property and tracing assets in both UK and foreign jurisdictions;
- Supporting FCA lawyers and instructed Counsel in restraint and confiscation proceedings, giving evidence in the Crown Court or High Court where appropriate;
- Supporting FCA lawyers in enforcing confiscation and property forfeiture orders obtained;
- Using plain language and highlighting key messages to stakeholders.

About you

Minimum
- Currently accredited, by the NCA, as a Financial Intelligence Officer, OR have previously held accreditation under Parts 8 and 2 POCA and be currently working in as an investigator in a financial crime role, particularly of NIM (National Intelligence Model) level 3 investigations (national and International) into FSMA or fraud offences, using a range of tools to further those investigations.

Essential
- Knowledge of ECHR and its impact on casework;
- Current experience of the legal obligations under Data Protection Act 2018 and Criminal Procedure and Investigations Act 1996.
- Knowledge of the Financial Services & Markets Act 2000 and Financial Services Act 2012 (on relevant criminal sections).
- The willingness to exercise your own judgement and initiative.
- Ability to flex style and influence senior leadership.
- Strong analytical and investigative skills.
- Strong drafting skills, communication and interpersonal skills.
- A "can-do" attitude and the ability to work under pressure and meet challenging deadlines.
- Commitment to undertake independent study and to attend the necessary courses, to successfully train as an Accredited Financial Investigator.

Desirable
- Understanding of the Serious Crime Act 2015 and Criminal Finances Act 2017 legislation and their impact on proceeds of crime work at the FCA.
- Use of Altia software or similar tools to analyse data and manage disparate unstructured financial information.
- Good knowledge and IT skills to ensure records and data management standards are met.

The work of an Accredited Financial Investigator is to support, proactively, the criminal investigations across Enforcement. We do this by providing dedicated financial investigation resource to:

- investigate, identify, restrain and confiscate the proceeds of criminal behaviours, seeking to remove these from convicted individuals;
- compensate victims wherever possible;
- use enforcement powers available to us to ensure confiscation orders are satisfied;
- use civil powers under Part 5 of the Proceeds of Crime Act 2002 and associated legislation to identify and forfeit recoverable property;
- undertake criminal investigations into money laundering offences under Part 7 POCA.
