DWF's national Real Estate Litigation team is seeking to recruit an Associate or Senior Associate, depending on experience, in Manchester, Liverpool, Leeds and/or Newcastle office.

The team is also recruiting the same in Leeds or Newcastle.

**The Team**

We form part of the Real Estate Practice Group.

We're a large team of around 20 lawyers and we operate nationally. That means everyone can get involved in work for all clients. We're a close, friendly, collaborative team and we have a focus on sharing knowledge, good lines of communications and proper supervision structures.

**The Work**

We advise clients on all types of commercial property dispute, such as lease renewals (opposed and unopposed), restrictive covenants, break options, dilapidations, rights of way, boundary disputes, trespass, nuisance, telecoms, possession and insolvency related issues.

We act for clients in a variety of sectors from hospitality, retail and technology to telecoms and the public sector. Our telecoms expertise is renowned and we act for big UK-wide electronic communications operators. This work covers all aspects of asset management, from lease renewals under the Act and Code, right of way disputes, access issues, upgrades and the roll out and ongoing management of new technologies such as 5G.

In addition to general commercial real estate litigation, telecoms work would be part of your practice. If you have experience in this sector that’s great, but if you don't and you are keen to get involved there is plenty of support for you to develop this niche in your practice.

Our solicitors work directly with our clients and we expect them all to take ownership of their work and develop and grow their own relationships with those clients.

As you would expect we deal with cases in the courts and tribunals at all levels, but we encourage settlement and the use of mediation and other forms of alternative dispute resolution. We differentiate ourselves in this way and our sector knowledge and experience means we are often involved in the commercial strategic direction for our clients.

Our team also works with DWF's Connected Services. This means that we have in-house businesses to deal with costs, advocacy and other work streams. We also work closely with DWF's Re:Flex division of real estate paralegals (to which all fee earners in the team have access). This means work is resourced appropriately and it provides a network of support for all lawyers to make sure repetitive or administrative fee earning tasks are delegated.

**The Vacancy**
- Experience in all aspects of commercial real estate litigation to include, for example:

- 1954 Act lease renewals (opposed and unopposed).
- Serving notices (contractual and statutory notices, e.g. break notices and 1954 Act notices).
- Dilapidations disputes and settlements.
- Boundary and right of way issues.
- Rent arrears and landlord remedies (including forfeiture, Court proceedings, CRAR etc.)
- Ideally some experience of telecoms law and the new Electronic Communications Code, including, for example, advising on:

- The status of operators' occupational rights (including renewing or terminating them).
- Recent cases under the Electronic Communications Code.
- Other issues related to the management and roll out of a mast estate.
- Acquiring rights by using the Electronic Communications Code (e.g. under paragraphs 20, 26, 27 and 33).
- The ambition to take ownership of and proactively progress a varied case load and at times manage client relationships.
- Excellent technical real estate litigation knowledge.
- The desire and ability to deliver a top client service across a range of sectors.
- The ability and desire to develop lasting relationships with clients and be a long-term member of an established but forward-thinking and growing team.
- A positive, friendly, supportive and collegiate approach to working with others.
- A desire to take on a supervisory and management role to develop people.
