Litigator - Timeshare Misselling

**Work Summary**
Timeshare is a description of a form of holiday ownership. Once acquired, you own a right, (either directly of through a “club”) to use a week/weeks in a specific accommodation. Alternatively, those rights are converted to points to be utilised for varying lengths of time, in different types of accommodation and at different resorts.
Types of issues which are known to arise:
- Financial Advisor Misselling and/or pressure to sign
- Rising maintenance fees
- Lack of affordability
- Unfair Contract Terms or change in Contract terms
- In Perpetuity Contract
- Problems exiting Timeshare Agreement
**Primary Duties**
- Run your own caseload to ensure that all claims are up to date and progressed in the correct time frame
- Taking potential customers through a full claim assessment and fact find over the phone and assessing if they have had a financial loss and if a claim can be made.
- To review incoming information and establish the claim route, whether that be litigation and/or a claim under Sections 75 and/or 140 Consumer Credit Act 1974
- Establish at the earliest opportunity an entity who a claim can be brought against
- Checking all compliance requirements were on the file; ie. Research, AML evidence, Terms of Business
- Request all relevant information from the relevant parties as soon as identified
- Be proactive and use initiative when presented with problems or issues
- Provide excellent customer service by regularly updating clients on the progress of their case, costs and answering any queries in a professional manner
- Be proactive in your approach to the role by constantly researching the area of law you practice and keeping up to date with all relevant case law/industry updates
**Attributes & Competencies Required**
- Required_
- Excellent technical skills in the field of litigation, an ability to make a considered judgement call and a proven history of meeting and exceeding client expectations.
- Organisational and prioritising skills are also essential to meet the demands of challenging internal and external clients.
- Good teamwork skills and the ability to communicate effectively with people at all levels are essential.
