**Introduction**

The role of Mental Health Act Lead is crucial to the running of Southleigh Community Hospital in ensuring patients rights are met and that the Hospital remains compliant and legal with the Mental Health Act and the Code of Practice.

**_1. ROLE PURPOSE _**:

- To be responsible for the day to day organisational running of the Mental Health Act

Legislation function, ensuring effective administrative procedures are implemented and comply with the statutory legislative responsibilities within the Mental HealthAct.
- To provide support in the organisation of Judicial Tribunals in response to the Mental

Health Act 1983 requirements.
- To act as a source of advice to patients, carers and other health professionals on matters relating to mental health legislation.
- Maintain and analyse of complex datasets.

**_2. CONFIDENTIAL INFORMATION _**:

The post-holder will have access to a wide range of confidential information relating to patients, staff and the company which must not be divulged to any unauthorised person in any circumstances, the post-holder will understand the policies and procedure regarding the use of Confidential Information and Act Protection Act.

**_3. DIMENSIONS _**
- To have an understanding of the Mental Health Act 1983 including the 2007 revisions to the act.
- Non-clinical information/advice to patients, carers and staff in relation to the Mental

Health Act and Mental Health Legislation regarding Tribunals and Managers hearings.
- Ensure the MHA Clinical spreadsheet is kept up to date with all legal and hearing information for other users within the Hospital to use.
- Ensure e-mds (our local EPR) is kept up to date with MHA data.
- Keep the digital and physical MHA files up to date.
- To archive patient files in an organised way
- Preparation and collation monthly, quarterly, and annual audits as instructed by the

Clinical Governance Department.
- To use office equipment in an appropriate manner, reporting any faults following the recognised organisational procedure

- Responsible for maintaining the highly confidential legal documentation on patient’s status under the Mental Health Act in a secure environment.

**_4. KEY RELATIONSHIPS _**

▪ To liaise with staff for the purpose of administering processes and procedures of the

Mental Health Act

▪ To liaise with Care Quality Commission, Department of Health, Mental Health Act

Tribunal, Solicitors, Multi-disciplinary Teams, Solicitors, external stakeholders and providers, patients and nearest relatives.

▪ The post-holder will be representing our services as a main point of contact and will need to have highly developed professional standards in their approach to all visitors, patients and staff.

▪ The post-holder has a duty to ensure that they are equipped with the necessary skills to undertake the tasks required of them and should seek clarification, training and guidance in any areas of deficit or uncertainty.

▪ The post-holder will have access to a wide range of confidential information relating to patients, staff and the company which must not be divulged to any unauthorised person in any circumstances.
