Solicitor

Reporting to the Head of Legal Services for a Medium sized construction business, the job holder will act and advise on protecting the Company and securing the best possible contractual and legal outcome in relation to any Contract terms, disputes or differenceswith the Employers or supply chain and provide competent legal knowledge support to the Estimating, Commercial and Production Teams to save from harm and optimise the profitability of the business. Provide assistance with personal injury claims and liaisewith the safety team in provision of information to insurers, loss adjusters and legal representatives.

**Responsibilities**:

- To maximise the opportunities for recovery of monies under the terms of both Main and Subcontracts by the provision of sound legal advice, guidance and support to the estimating, commercial and production teams
- Oversee appointment of external lawyers in matters of litigation and assist with the provision of documents required in defence of claims.
- Have a full understanding of the operation of the conditions of contracts and amendments made to same.
- To protect the business as far as possible from claims arising from the supply chain or employers and assist and guide the teams in the timely administration of notices as appropriate.
- Take an active role in the placing of performance bonds, ensuring timely release of same and review and understand the various wordings and deal with the broker and sureties to ensure the company has sufficient capacity.
- Review and understand the section agreements required to be entered into to secure adoption of roads sewers and pumping stations etc.
- Have a full understanding of the Adjudication process and the Housing Grants Act as amended and advise the commercial team on the processes necessary to ensure compliance.
- Provide expertise, advice and oversee insurance claims for both personal injury and property damage and support the insurers solicitors with the knowledge of our contracts and the evidence to defend costs
- Have a good working knowledge of the law as it relates to construction issues and claims and work with and appoint legal advisors to work on behalf of the company where appropriate
- Deal with and advise the commercial team in relation to insolvency agents and the interface with supply chain failures to ensure the best outcome.
- Advise on claims from Utilities regarding damage to plant and equipment
- Conversant with all JCT Forms of Contract, and recent updates
- Understanding of the Housing Grants Act and amendments
- Working knowledge of construction and insolvency law as it affects contracts and sub-contracts
- Conversant with Sub-contract terms in general use.
- Ability to manage staff
- Experience of submission and defence of loss and expense claims
