Positive Employment is currently recruiting for a Licensing Officer for our client based in Teignbridge. The successful candidate will be the main point of contact for Licensees, members of the public, Councilors, Police and Fire Authorities and representatives of Local Authority departments in coordinating, processing and issuing licences under the Licensing Act 2003 and other statutory provisions. This is a contract position for 3 months with the possibility of extensions. Duties and Responsibilities but not limited to:

  • Ensuring all applications are processed to statutory deadlines in accordance with the appropriate legislation and in full consultation with the appropriate statutory consultees and other bodies.
  • Negotiate with applicants and objectors including their agents (solicitors, barristers and licensing consultants) when dealing with applications.
  • Liaise with and attend such meetings as required with external authorities who have an involvement under the various legislations for which licensing is responsible for example Police, Fire, Trading Standards, Child Protection Agency and Gambling Commission.
  • Undertaking inspections and enforcement for all licensing matters to ensure compliance with legislation and any conditions.
  • Liaise and assist with enquiries concerning licensing issues from officers within the Authority including Environmental Health (Noise and Food/Safety), Community Safety and Safeguarding and TDC Planning.
  • In the absence of the Licensing Manager, organise and undertake multi-agency visits involving representation of Police, Fire, Building Control and Environmental Health to monitor the performance of individual premises and impact of grouped premises in sensitive areas, ie. Town centres and residential areas.
  • Follow existing policy and procedure for vetting of all prospective drivers to ensure they are a ‘fit and proper’ person, for example medical, police checks and driving licenses.
  • Deal with members of the public written / telephone complaints and enquiries in relation to any licensing matters.
  • Produce draft reports. Give advice in preparation for Regulatory and Appeals Committee meetings and present cases.
  • Write reports and attends meetings of the Regulatory and Appeals Committee with regard to the conduct of Hackney Carriage Drivers and Operators and the Licensing Act Sub-Committees to present these reports in relation to the Licensing Act 2003 and Gambling Act 2005 and respond to requests for information from Members.
  • Preparing files and submitting evidence and other documentation in legal proceedings. Investigating, gathering evidence including taking witness statements and conducting PACE interviews. Attending court and representing the Council as witness, if required.
  • Participate in multi-agency visits (including out of hours working) to inspect compliance with licensing legislation including that relating to taxis, Licensing Act 2003 Page 3 of 9 and Gambling Act 2005 and to check and advise applicants on potential large scale events including country shows and festivals held in the district.
  • In conjunction with the Licensing Manager discuss income and expenditure in line with the annual budget to be set.
  • Check and reconcile all payments of monies for licenses and ensure they are recorded and paid to the Authority to the correct codes.
  • Assist Licensing Manager with drafting, consulting and updating policies including presenting to committee.
Personal Requirements:
  • It is desirable to have a clear knowledge and understanding of all licensing legislation i.e. Local Government (Miscellaneous Provisions) Act 1982, Charities Act 1992, House to House Collections Act 1939, Gambling Act 2005, Licensing Act 2003, Local Government (Miscellaneous Provisions) Act 1976 and Town and Police Clauses Act 1847.
  • It is desirable to hold the BIIAB Level 2 National Certificate for Licensing Practitioners.
  • Previous experience of working in licensing or a related field.
  • The ability to prepare and present concise reports for committee hearings.
  • Good presentation skills in order to present reports to committee hearings.
  • It is desirable to have a thorough working knowledge and training in P.A.C.E. (Police and Criminal Evidence Act).
  • Interview skills to carry out interviews under caution, new drivers.
  • Full driving licence with insurance to cover business use.
  • Working out of normal office hours, if required.
